A Shifting Landscape
Organisations are operating in an environment where regulation and employment law are evolving rapidly. From flexible working rights and holiday pay reforms to new requirements around transparency and fair treatment. HR leaders are under growing pressure to stay compliant while still supporting business flexibility.
The Challenge for Employers
On one hand, legislation is becoming tighter, with more scrutiny around equality, worker status, and employee rights. On the other, businesses are navigating fast-moving markets where flexibility, innovation, and speed are critical to survival. This creates a tension: how do you stay on the right side of the law without slowing down the organisation?
Common challenges include:
- Responding to new flexible working regulations from day one of employment
- Adapting policies to align with changing holiday pay and working time rules
- Ensuring compliance in hybrid work environments, including health and safety
- Balancing cost pressures with new requirements for transparency and fair treatment
Key Upcoming UK Employment Law Changes
The Employment Rights Bill and related measures will roll out in phases from late 2025 through 2027, with major reforms including:
- Ban on Fire & Rehire → consultation in Autumn 2025, full restrictions expected October 2026
- Statutory Sick Pay Reform → effective April 2026, removing thresholds and waiting periods
- Day-One Rights for Parental Leave → new entitlements from April 2026
- Ban on Non-Disclosure Agreements →silencing harassment/discrimination claims → announced July 2025
- Employment Rights Bill Roadmap → phased reforms across 2025–2027
Finding the Balance
The most effective HR strategies are those that treat compliance not as a barrier, but as a foundation. Clear, up-to-date policies provide allows innovation in other areas—whether that’s introducing new ways of working, reshaping roles, or trialling different approaches.
